Understanding Florida's Manslaughter Laws

In the state of Florida, you could be charged with manslaughter under one of three circumstances: manslaughter by act, manslaughter by procurement or manslaughter by culpable negligence. Each of these crimes will result in second degree felony charges if the killing was neither justified nor excusable under the law.

  • Manslaughter by Act: you could be charged with this crime if your actions are intentional and neither excusable, nor justified.
  • Manslaughter by Procurement: you could be charged with this crime is your negligent conduct results in the death of another person.
  • Manslaughter by Negligence: you could be charged with this crime if you persuade another person to commit an act that results in death.

Manslaughter under any of these circumstances is a felony of the second degree. If you are convicted, the court is required to impose a minimum sentence of 9¼ years in prison. Maximum penalties include up to 15 years in prison and $10,000 in fines.

When Manslaughter Becomes a First Degree Felony

According to Florida Statute § 782.07, manslaughter becomes a first degree felony if aggravating factors are present at the time of the killing. Aggravated manslaughter of an elderly person or disabled adult, aggravated manslaughter of a child and aggravated manslaughter of an officer or firefighter are all first degree felonies.

  • Manslaughter of an Elderly Person: you could be charged with this crime if you cause the death of an elderly person or disabled adult.
  • Manslaughter of a Child: you could be charged with this crime if you cause the death of any person under the age of 18.
  • Manslaughter of a Police Officer: you could be charged with this crime if you cause the death of an officer, firefighter, EMT or paramedic.

Manslaughter under any of these circumstances is a felony of the first degree. If you are convicted, the court is required to impose a minimum sentence of 9¼ years in prison. Maximum penalties include up to 30 years in prison and $10,000 in fines.
